1. Introduction
Welcome to our Computer Institute and Center Registration Platform. These Terms and Conditions ("Terms") govern your use of our services, including but not limited to center registration, student enrollment, course access, and all related services provided by our institute.
By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services. These Terms constitute a legally binding agreement between you and our institute.
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.
2. Definitions
"Institute" refers to our computer training institute and its authorized representatives.
"Center" refers to an authorized training center or franchise partner registered with the institute.
"Student" refers to any individual enrolled in any course or program offered by the institute or its authorized centers.
"Services" refers to all educational services, training programs, courses, certifications, and related services provided by the institute.
"Platform" refers to our website, online learning management system, and all digital platforms operated by the institute.
"Content" refers to all materials, including but not limited to course content, study materials, videos, documents, software, and intellectual property provided through our services.
"User" refers to any individual or entity accessing or using our services, including students, center administrators, and visitors.
"Account" refers to the user account created for accessing our services.
3. Registration and Enrollment
3.1 Center Registration
Centers seeking authorization must complete the registration process, provide accurate and complete information, and submit all required documents. The institute reserves the right to approve or reject any registration application at its sole discretion.
Upon approval, centers will receive a unique Center Code and User ID. Centers must maintain the confidentiality of their credentials and are responsible for all activities conducted under their account.
Centers must comply with all institute policies, maintain required infrastructure, and adhere to quality standards as specified by the institute. Failure to meet these requirements may result in suspension or termination of center authorization.
3.2 Student Enrollment
Students may enroll in courses through authorized centers or directly through the institute. Enrollment is subject to availability and completion of all required procedures, including payment of applicable fees.
Students must provide accurate personal information during enrollment. Any false or misleading information may result in immediate termination of enrollment and forfeiture of fees paid.
The institute reserves the right to refuse enrollment to any individual who does not meet course prerequisites or who has previously violated these Terms.
3.3 Account Security
Users are responsible for maintaining the confidentiality of their account credentials. Users must immediately notify the institute of any unauthorized access or security breach. The institute is not liable for any loss or damage resulting from unauthorized account access.
4. Fees and Payments
4.1 Course Fees
All course fees are as specified at the time of enrollment. Fees are subject to change, but changes will not affect already enrolled students for their current course duration. Fees must be paid in full or as per the agreed payment schedule before course access is granted.
Additional fees may apply for certification, examination, study materials, or other services. All fees are non-negotiable unless otherwise specified in writing by authorized institute representatives.
4.2 Payment Methods
Payments may be made through authorized payment methods including online payment gateways, bank transfers, cash deposits, or other methods as specified by the institute. All payments must be made in the currency specified by the institute.
Transaction fees, if any, are the responsibility of the payer. The institute is not responsible for any additional charges imposed by payment processors or financial institutions.
4.3 Late Payments
Late payment fees may apply for overdue payments. The institute reserves the right to suspend services, including course access, for accounts with outstanding payments. Reinstatement of services may require payment of all outstanding amounts plus applicable late fees.
4.4 Refunds
Refund policies are detailed in Section 9 of these Terms. Refunds, if applicable, will be processed according to the institute's refund policy and may take 15-30 business days to reflect in the original payment method.
5. Course Content and Curriculum
5.1 Course Materials
All course content, including but not limited to lectures, videos, documents, software, assignments, and assessments, is the intellectual property of the institute or its licensors. Course materials are provided for personal, non-commercial use only.
Students and centers may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any course materials without explicit written permission from the institute.
5.2 Curriculum Updates
The institute reserves the right to update, modify, or discontinue course content, curriculum, or programs at any time to reflect industry changes, technological advancements, or educational improvements. The institute will make reasonable efforts to notify enrolled students of significant changes.
Students enrolled in ongoing courses will continue to receive the curriculum version they enrolled in, unless otherwise specified. New enrollments will receive the most current curriculum version.
5.3 Course Access
Course access is granted for the duration specified at the time of enrollment. Access may be extended or modified at the institute's discretion. The institute reserves the right to limit or revoke access for violations of these Terms or for technical or administrative reasons.
Students are responsible for ensuring they have adequate internet connectivity, hardware, and software to access online course materials. The institute is not responsible for technical issues on the student's end.
5.4 Certification
Certificates are issued upon successful completion of course requirements, including passing all assessments and examinations. The institute reserves the right to withhold certificates for non-compliance with course requirements or violations of these Terms.
Certificates are issued in the name provided during enrollment. Name changes or corrections may be subject to administrative fees. Replacement certificates may be issued for lost or damaged certificates upon payment of applicable fees.
6. Student Conduct
6.1 Code of Conduct
All students and users must conduct themselves in a respectful, professional, and ethical manner. Prohibited conduct includes, but is not limited to:
- Harassment, discrimination, or abusive behavior towards instructors, staff, or other students
- Sharing account credentials or allowing unauthorized access to course materials
- Cheating, plagiarism, or academic dishonesty in assessments or examinations
- Posting inappropriate, offensive, or illegal content on institute platforms
- Attempting to hack, disrupt, or interfere with institute systems or services
- Violating intellectual property rights or copyright laws
- Engaging in any activity that may harm the institute's reputation or operations
6.2 Academic Integrity
Students must maintain the highest standards of academic integrity. All submitted work must be original and properly attributed. Plagiarism, cheating, or any form of academic dishonesty will result in immediate disciplinary action, including possible expulsion and forfeiture of fees.
6.3 Disciplinary Actions
Violations of the code of conduct may result in warnings, suspension of services, termination of enrollment, legal action, or other appropriate disciplinary measures. The institute reserves the right to determine appropriate disciplinary action based on the severity of the violation.
7. Intellectual Property
7.1 Ownership
All content, materials, software, trademarks, logos, and intellectual property provided through our services are owned by the institute or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Users are granted a limited, non-exclusive, non-transferable license to access and use course materials for personal, non-commercial educational purposes only. This license does not include the right to reproduce, distribute, modify, or create derivative works.
7.2 User-Generated Content
By submitting any content, including assignments, feedback, or communications, users grant the institute a perpetual, worldwide, royalty-free license to use, reproduce, modify, and distribute such content for educational and promotional purposes.
Users represent and warrant that they have all necessary rights to grant such licenses and that their content does not infringe upon any third-party rights.
7.3 Trademark Usage
Authorized centers may use institute trademarks and logos as specified in their authorization agreement. Unauthorized use of institute trademarks, logos, or branding is strictly prohibited and may result in legal action.
8. Privacy and Data Protection
8.1 Data Collection
The institute collects and processes personal information necessary for providing educational services, including but not limited to name, contact information, educational background, payment information, and course progress data.
We also collect technical information such as IP addresses, browser type, device information, and usage data to improve our services and ensure platform security.
8.2 Data Usage
Personal information is used to provide and improve our services, process enrollments and payments, communicate with users, issue certificates, comply with legal obligations, and for other purposes as described in our Privacy Policy.
We may share information with authorized centers, service providers, and partners as necessary to deliver our services, subject to appropriate confidentiality and data protection measures.
8.3 Data Security
The institute implements reasonable security measures to protect personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is completely secure.
Users are responsible for maintaining the security of their account credentials and should not share their login information with others.
8.4 Data Retention
We retain personal information for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Users may request deletion of their personal information subject to legal and operational requirements.
9. Refund and Cancellation Policy
9.1 Student Cancellation
Students may cancel their enrollment within 7 days of enrollment and receive a full refund, provided no course materials have been accessed or downloaded. Cancellation requests must be submitted in writing to the institute or authorized center.
After the 7-day period, refunds are calculated on a pro-rata basis based on course completion and may be subject to administrative fees. No refunds are provided after 50% of the course duration has elapsed.
9.2 Institute Cancellation
The institute reserves the right to cancel or reschedule courses due to insufficient enrollment, instructor unavailability, technical issues, or other circumstances beyond our control. In such cases, students will be offered a full refund or the option to transfer to another course.
9.3 Refund Processing
Refunds, if approved, will be processed within 15-30 business days to the original payment method. Processing times may vary depending on the payment method and financial institution.
Refunds are not available for completed courses, issued certificates, or for services already rendered. Administrative fees, examination fees, and certification fees are generally non-refundable.
9.4 Center Registration Fees
Center registration fees and authorization fees are non-refundable. In case of center authorization termination, any unused portion of annual fees may be refunded at the institute's discretion, subject to deduction of applicable charges.
10. Liability and Disclaimers
10.1 Service Availability
The institute strives to provide continuous and reliable service but does not guarantee uninterrupted or error-free access to our platform or services. Services may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.
The institute is not liable for any loss or damage resulting from service interruptions, technical failures, or inability to access course materials.
10.2 Educational Outcomes
While the institute provides quality education and training, we do not guarantee specific educational outcomes, job placements, salary increases, or career advancement. Success depends on individual effort, aptitude, and external factors beyond our control.
The institute is not responsible for employment decisions made by third-party employers or for the recognition of certificates by external organizations or institutions.
10.3 Limitation of Liability
To the maximum extent permitted by law, the institute's total liability for any claims arising from or related to our services shall not exceed the total fees paid by the user for the specific course or service in question.
The institute shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
10.4 Third-Party Services
Our services may include links to third-party websites, software, or services. The institute is not responsible for the content, privacy practices, or availability of third-party services. Users access third-party services at their own risk.
11. Center and Institute Obligations
11.1 Center Obligations
Authorized centers must maintain adequate infrastructure, including computer labs, internet connectivity, and qualified instructors as specified by the institute. Centers must comply with all institute policies, maintain quality standards, and provide proper student support.
Centers must accurately represent institute programs, maintain student records, submit required reports, and remit fees as per the authorization agreement. Centers are responsible for their own operations, staffing, and compliance with local laws and regulations.
11.2 Institute Obligations
The institute will provide course materials, curriculum, training support, and administrative services as specified in the authorization agreement. The institute will maintain quality standards, provide technical support, and work to ensure the success of authorized centers.
The institute will process enrollments, issue certificates, maintain student records, and provide ongoing support to centers and students as reasonably required.
11.3 Quality Assurance
The institute reserves the right to conduct audits, inspections, or quality assessments of authorized centers. Centers must cooperate with such assessments and address any identified deficiencies within specified timeframes.
12. Student Rights and Responsibilities
12.1 Student Rights
Students have the right to receive quality education, access course materials, receive instructor support, participate in assessments, and obtain certificates upon successful completion. Students have the right to privacy, fair treatment, and to file complaints or grievances.
Students have the right to access their personal information, request corrections, and withdraw from courses subject to applicable refund policies.
12.2 Student Responsibilities
Students are responsible for attending classes, completing assignments, participating in assessments, maintaining academic integrity, and complying with all institute policies and these Terms. Students must pay fees on time, maintain account security, and use course materials appropriately.
Students are responsible for ensuring they meet course prerequisites, have necessary equipment and software, and maintain adequate internet connectivity for online courses.
13. Termination
13.1 Termination by User
Students may terminate their enrollment at any time by submitting a written request. Termination is subject to applicable refund policies. Upon termination, access to course materials and services will be revoked.
Centers may terminate their authorization by providing written notice as specified in their authorization agreement. Termination may be subject to notice periods and other contractual obligations.
13.2 Termination by Institute
The institute may terminate or suspend user accounts, center authorizations, or services immediately for violations of these Terms, non-payment, fraudulent activity, or other serious misconduct. The institute may also terminate services for operational, legal, or regulatory reasons.
Upon termination by the institute, users forfeit access to services and may forfeit fees paid, except as required by applicable law or refund policies.
13.3 Effect of Termination
Upon termination, all rights and licenses granted to users immediately cease. Users must cease all use of institute services, return or destroy all course materials, and may be required to return any institute property or materials in their possession.
Provisions of these Terms that by their nature should survive termination, including but not limited to intellectual property rights, liability limitations, and dispute resolution, shall survive termination.
14. Dispute Resolution
14.1 Informal Resolution
Users are encouraged to contact the institute directly to resolve any disputes or concerns. The institute will make reasonable efforts to address and resolve complaints in a timely and fair manner.
14.2 Mediation
If informal resolution is unsuccessful, parties agree to attempt mediation through a mutually agreed mediator before pursuing legal action. Mediation costs will be shared equally unless otherwise agreed.
14.3 Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or our services shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where the institute is located.
Users agree to submit to the jurisdiction of such courts and waive any objections to venue or jurisdiction.
15. Amendments and Modifications
The institute reserves the right to modify, update, or amend these Terms at any time. Material changes will be communicated through email, website notifications, or other reasonable means at least 30 days before they take effect.
Continued use of our services after modifications constitutes acceptance of the updated Terms. If users do not agree with modifications, they must discontinue use of our services and may terminate their enrollment or authorization as applicable.
Users are responsible for regularly reviewing these Terms to stay informed of any changes. The "Last Updated" date at the top of this document indicates when these Terms were last revised.
16. Miscellaneous Provisions
16.1 Entire Agreement
These Terms, together with any authorization agreements, enrollment forms, or other written agreements, constitute the entire agreement between users and the institute regarding the use of our services.
16.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16.3 Waiver
Failure by the institute to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of the institute.
16.4 Assignment
Users may not assign or transfer their rights or obligations under these Terms without prior written consent from the institute. The institute may assign or transfer these Terms or its rights and obligations to any successor or affiliate.
16.5 Force Majeure
The institute shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, or failures of third-party services.
16.6 Notices
All notices, communications, and legal documents must be in writing and delivered to the addresses specified in the authorization agreement or enrollment documents, or to the institute's registered address. Notices may be delivered by email, registered mail, or other methods as specified.
